			<content:encoded><![CDATA[<p>Many people who have gone through the incredibly stressful process of a foreclosure may believe that, once the foreclosure is completed, they can at last put the issue of their mortgage debt behind them and begin to rebuild. However, homeowners in most states often find that foreclosure is not the end of the story. The general rule in most states today is that lenders can pursue “deficiencies” to continue to collect mortgage debt on a home even after it has been disposed of through foreclosure.</p>
<p><strong>How does this happen?</strong> When a property is sold through the <a href="http://www.alliottslaw.com/faq/foreclosure-101/">foreclosure</a> process, the price paid may not cover the entire balance of the mortgage or mortgages on the home. Rather than absorbing those losses, the lender make seek a deficiency judgment against the foreclosed homeowner for the amount of the mortgage that was not satisfied by the sale of the property. That means that even though the homeowner has lost the property through foreclosure, a judgment can be issued against them making them legally obligated to repay the balance of the mortgage.</p>
<p>Deficiency judgments leave the original homeowner in a particularly precarious situation: although they no longer own the home and therefore cannot build any equity in it, they are still obligated to make payments on the home loan(s). Moreover, that additional debt can be a significant burden to individuals seeking future credit.</p>
<p>Filing for bankruptcy after <a href="http://ezinearticles.com/?Should-You-Consider-Chapter-7-or-Chapter-13-Bankruptcy?&amp;id=6966228">foreclosure</a> is an appealing option in these cases. As with other types of debt, mortgage debt remaining under a deficiency judgment can be wiped out and eliminated entirely, leaving the individual with a blank slate and the ability to begin the financial and emotional rebuilding process.</p>
<p>However, filing for bankruptcy before the home is lost to foreclosure is much better fro the homeowner.  Among other things, the homeowner will automatically avoid his or her tax liability for the Form 1099 that the lender sends to the IRS after the foreclosure for the cancellation of debt income tax, the homeowner will be able to stay in his or her home for more time, and the homeowner may have another opportunity to modify the home loan.</p>

			<content:encoded><![CDATA[<p>Many people assume, incorrectly, that bankruptcy means that he or she will lose all of their assets.  That is simply not the case.  The federal bankruptcy laws, in combination with California law, protect specific types of property for the benefit of the person seeking bankruptcy relief.  These laws are known as exemptions.  Exemptions are very specific and usually limited in amount that can be protected.  These amounts may also vary depending on the specific circumstances of the debtor; for example, a person is automatically entitled to &#8220;exempt&#8221; up to $70,000 in equity in his or her primary residence, but the same person could exempt a higher amount if he or she is disabled.  To the extent that the value of the asset is more than the amount of the exemption, the difference may be the subject of a demand by the bankruptcy trustee.  In addition to exemptions, other assets may be protected by other laws.  For example, a qualified retirement plan, such as a 401(k) or a union pension, which are established under federal employment and tax laws, is also &#8220;excluded&#8221;, or protected,  from the bankruptcy estate.</p>
<p>Certainly, an analysis of a person&#8217;s assets as well as the exemptions and exclusions available to protect them is an important aspect of representing individuals in bankruptcy cases.  In the majority of cases, a person&#8217;s assets can be protected by the available exemptions and exclusions.  However, to the extent that a person cannot protect all of his or her assets, such person may consider other strategies.  Again, the sooner a person seeks advice, the greater the options available to shield such assets.</p>

<p>Ha habido muchas noticias sobre propuesta de acuerdo entre los bancos y los generales de los abogados de los estados sobre la ejecución hipotecaria y sus practicas.The reacción al inicio del  de la propuesta fue favorable ya que muchos propietarios esperaban que les ayudaría a modificar sus préstamos para la vivienda de una manera significativa . Después de un análisis más ha habido muchas críticas a la propuesta. Independientemente de las forma en que percibe el acuerdo propuesto, la gente  deve entender que sus términos se llevará muchos meses, si no hasta un año para poner en práctica sus términos.</p>
<p>Hace poco recibí un e-mail del Centro de la Ley de Watsonville y de la ejecución de una hipoteca corporativa costa central, que establece los siguientes puntos de vista útiles en lo que en realidad se puede esperar de la propuesta:</p>
<p>Pasos hacia la curación de la crisis hipotecaria</p>
<p>Los propietarios de viviendas que luchan para hacer sus pagos de la hipoteca serán elegibles para una modificación del préstamo, incluyendo reduciones a la cantidad principal del préstamo. El acuerdo entre el Abogado del Estado 49 funcionarios goveramentales  generales federales y cinco de los administradores más grandes del país hipotecarios es la de ofrecer algún alivio a los propietarios de viviendas que tuvieron  documentación fraudelente (robosigning) y los leevo a la perdida de su casa.</p>
<p>Los propietarios que han perdido sus hogares por ejecución hipotecaria recibirán  un pequeño pago en efectivo y tendrán el derecho a demandar, y participar en otras demandas.</p>
<p>Los propietarios de viviendas perdidas pueden esperar de la liquidación $ 25 mil millones:</p>
<p>Reduccion Principal: Muchos propietarios tendrán tendrán una reducción de $20,000en reducción de su principal esto será por hasta $17 mil millones y algunos serán beneficiados.</p>
<p>Restitucion: Algunos propietarios que perdieron su propiedad por ejecución hipotecaria entre 2008-2011 recibiran un pago de $2000. Los formularios serán enviados y los prestamistas se pondrán en contacto con su estado.</p>
<p>Tasa de reducción: Los propietarios que están al corriente pero su propiedad no vale lo que debe tendrán la opción de refinanciar para obtener un interés mas bajo.</p>
<p>Doble via ban: Servicios no podrán ejecutar la hipoteca del propietario mientras que esta siendo evaluado par aun préstamo o modificación.</p>
<p>Unico contacto de los servicios: proveran un particular contacto a los propietarios cuando ellos estén en problemas financieros.</p>
<p>Derecho de apelación: Los propietarios de viviendas que se les niega una modificación de préstamo tendrán el derecho de apelar.</p>

<p>There has been a lot of news about the proposed settlement between the banks and states&#8217; attorneys&#8217; generals over the banks&#8217; poor foreclosure practices.  The initial reaction to the proposal was favorable, as many homeowners hoped it would help them modify their home loans in a meaningful way.  Upon further analysis, there has been a growing chorus of criticism over the proposal.  Regardless of how you perceive the proposed settlement, people have to understand that its terms will take many months, if not a year, to implement its terms.</p>
<p>That said, I recently received an e-mail from the Watsonville Law Center and the Central Coast Foreclosure Cooperative, which set forth <strong><em></em></strong>the following helpful insights into what homeowners can realistically expect from the settlement:</p>
<p><strong><em>Steps toward healing the housing crisis</em></strong></p>
<p>Homeowners struggling to make their mortgage payments will be eligible for loan modifications &#8211; including reductions to the principal loan amount. The settlement between 49 state Attorneys General (AG), federal government officials and five of the country&#8217;s biggest mortgage servicers is to offer some relief to homeowners after fraudulent documentation (&#8220;robosigning&#8221;) exacerbated the foreclosure crisis.</p>
<p>Homeowners who have lost their home to foreclosure will receive a small cash payment, will retain the right to sue, and to participate in other settlements.</p>
<p><em>Here&#8217;s what homeowners can expect from the $25 Billion settlement:</em></p>
<p><strong>Principal reduction</strong> &#8212; Some homeowners will have the amount that they originally borrowed reduced by $20,000 on average. Servicers are required to reduce principal loan amounts by up to $17 billion.</p>
<p><strong>Restitution </strong>- Homeowners who have lost their home to foreclosure (between 2008 and 2011) will receive about a $2,000 payment. Forms will be sent to borrowers or contact your state A.G.</p>
<p><strong>Rate reduction</strong> &#8211; Borrowers who are &#8220;underwater&#8221; and current on their mortgage payment will be able to refinance at lower interest rates. (Underwater homes are worth less than what&#8217;s owed on the mortgage)</p>
<p><strong>Dual track ban-</strong>- Servicers may no longer foreclose on homeowners while they are being evaluated for a loan modification.</p>
<p><strong>Single contact</strong>: Servicers will provide a particular contact for homeowners when they are in financial trouble.</p>
<p><strong>Right to appeal:</strong> Homeowners who are denied a loan modification will have the right to appeal.<br />

			<content:encoded><![CDATA[<p>La mayoría de las personas incluyendo muchos contadores no se dan cuenta de una obligación tributaria que puede resultar de una ejecución hipotecaria. Por lo general cuando una propiedad es vendida en venta corta o fue ejecución el balance es cancelado para el prestamista.  A su vez el prestamista esta obligado por ley federal de informar la cancelación de deudas al IRS y el prestamista  trata esta cancelación como ingreso  al deudor el cual ahora tiene que pagar impuestos en la deuda cancelada aunque el deudor nunca recibió ningún dinero. Lo ultimo que un propietario quiere  es que después de perder su propiedad tenga una obligación con el IRS.</p>
<p>Hay dos excepciones a al regla establecida. Una es para demostrar que el deudor es insolvente teniendo en cuenta sus pertenencias y deudas a partir del dia antes de la ejecucion de su propiedad. La otra excepción es presentar un caso de bancarrota antes de ese evento y con éxito completar el caso a si la obligación tributaria en el formulario 1099 sera perdonado. Por ejemplo, una de las excepciones temporales que se limita a los prestamos que son  para una persona primaria y el préstamo tiene que ser la hipoteca original la cual fue utilizada para comprar la casa por lo que si una persona refinancio su hipoteca esta excepción a la regla de impuestos no se aplica y la persona seria responsable a menos que algunas otras excepciones apliquen.</p>
<p>Mi experiencia es que muchas personas que compraron casa durante la burbuja y posteriormente perdieron sus hogares califican para la excepción de insolvencia. Sin embargo las personas que tienen importante capital o un buen retiro deben estar consientes de este impuesto. La responsabilidad  podría resultar en una perdida de la totalidad o una porción sustancial de sus pertenencias. Un caso de bancarrota podría evitar estos problemas . Claro que muchos agentes y otros profesionales no están consientes o no entienden este impuesto. Como resultado de ello la gente tiene que buscar asesoramiento adecuado. Lo mejor es siempre buscar asistencia legal antes de entregar una propiedad.</p>

			<content:encoded><![CDATA[<p>Lo siento por no haber publicado la semana pasada pero fui de vacaciones. Me fui a Oaxaca, Mexico por tercera vez. Sigue siendo un buen destino en esa región de Mexico. La ciudad de Oaxaca tiene una gran cantidad de ruinas que se conocen como Monte Alban las cuales  vale la pena explorar. La ciudad tiene mucha cultura y es muy placentero tienen la plaza y buena comida en el Zocalo.  De la ciudad de Oaxaca tomamos un avión pequeño el cual me llevo a Puerto Escondido. Son 200 millas de una belleza de costa intocable y limpia  aunque pienso que eso cambiara en el futuro. Es un lugar excelente para surfear con grandes olas del mar. Los mariscos son muy frescos y hay buenos lugares entre Puerto Escondido y Huatulco. Fui por una semana pero me hubiera gustado ir por dos. Pero no se pudo el trabajo me esperaba.</p>
<p>En cuestión de trabajo la hora de hacer impuestos ya esta aquí. Y decidi escribir  un poco en relación a los impuestos y la bancarrota. Primero mucha gente tiene la impresión de que los impuestos nunca pueden ser descargado en una bancarrota. Eso no es verdad bajo ciertas circunstancias tal vez si sea posible eliminar impuestos. Hay muchas restricciones y ciertas condiciones para que los impuestos sean descargado asi que debe tener sus precauciones. Por lo general se pueden descargar los impuestos si son mas de tres años siempre y cuando la persona presento sus declaraciones de impuestos. Lo importante es obtener consejos confiables sobre la forma de lograr ese objetivo, ya que hay muchas reglas y excepciones a la regla. Por lo tanto un adecuado asesoramiento de un profesionista es esencial.</p>
<p>Un segundo punto es que se puede hacer con las obligaciones de impuestos que no pueden ser descargadas en bancarrota. Como muchos sabemos el IRS es poderoso y puede ser un colector agresivo. El IRS puede embargar parte de su sueldo puede ir sobre sus cuentas bancarias y por sus propiedades personales. Si tiene obligaciones con el IRS y estas deudas no pueden ser descargadas en bancarrota en el capitulo 13 usted puede hacer un plan de pago para poder pagar su deuda. Esto tiene muchas ventajas por no tiene que pagarles intereses ni penalidades, de cuando usted hace su bancarrota esa es la deuda por la cual usted es responsable. A si que usted puede pagar esta deuda por un periodo de hasta cinco años. Esto es mas razonable para el deudor ya que el resultado final es que el cliente tiene una mayor flexibilidad financiera para sus necesidades y puede comenzar  a reconstruir su crédito personal mas rápido e ir en dirección positiva.</p>

			<content:encoded><![CDATA[<p>Sorry for not posting last week, but I was on vacation.  As an aside, I went to Oaxaca, Mexico for the third time.  It remains a great destination in the Southwestern part of the country.  The city of Oaxaca has an excavation site with a lot of ruins known as Monte Alban, which is worth exploring for a half day.  The city itself has a lot of culture and is a very pleasant, walkable place with good food and a central plaza, the Zocalo, that is great for people watching.  From there, we took a small plane to the coastal city of Puerto Escondido.  The 200-mile coast is beautiful and relatively unspoiled, although it appears that that will change in the years ahead.  Still, it&#8217;s great for body-surfing or regular surfing, being the home of the Mexican pipeline.  The seafood is fresh and there are many great destinations between Puerto Escondido and Huatulco to the south.  I was there for a week, but wish I had stayed for two.  Alas, I could not because of work.</p>
<p>On the question of work, tax season is upon us.  As such, I thought I would address some issues relating to taxes and bankruptcy.  First, many people have the impression that taxes can never be discharged in bankruptcy.  That is not true.  Under certain circumstances, income taxes can be discharged in bankruptcy.  There are many rules and conditions to discharging such taxes and you need to be careful about them.  But, generally, you can discharge income taxes if they are more than three years old, provided the person filed their returns.  Thus, for those who owe a significant amount of back taxes, a person may wish to consider bankruptcy as a way of eliminating such taxes.  As noted above, a person needs to get reliable advice on how to properly accomplish that goal, as there are many rules and exceptions to the rule.  Thus, proper counseling by a qualified bankruptcy attorney is essential.</p>
<p>A second point is what can be done with tax obligations that cannot be discharged in bankruptcy.  As most people know, the IRS is powerful and can be an aggressive debt collector.  The IRS can garnish wages, levy on bank accounts and put liens on real estate and personal property.  Such actions can crush an individual&#8217;s personal finances.  However, even if a person has tax obligations that cannot be discharged in bankruptcy, a person can set up a payment plan under Chapter 13, which has many advantages.  In Chapter 13, the IRS cannot charge any more interest or penalties; thus, the amount of taxes that is owed as of the date that the Chapter 13 is started is all that the client has to pay.  Further, those taxes can be paid over a period of five years.  Given that amount of time, the monthly payment is more reasonable than the payments that the IRS usually recovers through it normal collection activities.  The end result is that the client then has greater financial flexibilities for his or her other needs, and can also begin rebuilding their personal credit to move forward in a positive direction.</p>
